A TEENAGER who breached his Anti Social Behaviour Order by acting in a drunken and disorderly manner has been fined £125.

Nineteen-year-old Jordan Cunningham, of Albert Place, Galashiels, was part of a group of disruptive youths who were sitting on a picnic bench at the Gala Policies beside the swimming pool shortly after 4pm on Thursday, June 19.

Selkirk Sheriff Court was told last Tuesday that the group - many of whom were underage - were drinking lager from tins and shouting and swearing which resulted in complaints being made to the police by passers-by walking their dogs.

Prosecutor Tessa Bradley said the group had left a lot of rubbish and had set fire to a tree branch.

When police arrived and started confiscating alcohol from the underagers Cunningham began shouting and swearing and remonstrated with the officers.

A check of the police computer revealed he was on an ASBO preventing him from drunken and disorderly behaviour and he was arrested.

Defence lawyer Iain Burke said Cunningham, who is on a Borders College football course, had been drinking a few cans with three friends and there was another group of 15 to 17-year-olds in the area as well and the noise got out of hand.

Mr Burke said his client accepted in hindsight he should have taken the telling from the police officers and left the scene but he continued remonstrating with them and as a result was arrested and spent a night in custody.

Sheriff Peter Paterson imposed the fine saying: “This will reduce some of your spending money for drink.”
