A HAWICK man involved in an altercation with police officers has been fined £300 at Jedburgh Sheriff Court.

Thirty-four-year-old Shane Clark pleaded guilty to the offence which happened in Hawick's Kenilworth Avenue on May 27 last year.

Clark obstructed two police officers after he had been stopped for an alleged motoring offence.

Depute fiscal Joanna Waller said that police witnesses were speaking to another driver on the A7 at Hawick at around 3pm on May 27, 2020, when they observed a vehicle go past them which they decided to follow.

They had reason to speak to the driver who is the now accused.

Ms Waller said the vehicle appeared to double back in an attempt to lose the officers but eventually the vehicle did stop.

He was told to stay in his vehicle but refused to do so and tried to walk past a female constable who urged him to stop by putting up her hand.

Another constable explained to Clark why he had been stopped and not allowed to leave and at this point he became aggressive and demanded to be let go.

He was warned he was going to be handcuffed and the incident was starting to attract the attention of a large group of members of the public.

Clark was flailing his arms around as he resisted attempts to put handcuffs on him.
He grabbed hold of the cuffs and suffered a cut to his thumb as a result.

A scuffle developed for several minutes until other officers arrived.

Defence lawyer Ed Hulme said his client was self-employed involved in scrap metal and car sales.

He explained the police had wanted to stop the car because it had vehicle registration plates inside the window instead of fixed to the car.

He added that Clark was under the impression the police did not like him and he had reacted.

In addition to the £300 fine, Clark was ordered to pay a £20 Victim Surcharge.
