A 33-YEAR-OLD woman refused to leave her partner's home in the Borders after a bust-up, Selkirk Sheriff Court was told.

Fiona Goodall, of Dunfermline, pleaded guilty to assaulting the man by throwing a mobile phone at him on January 12 and behaving in a threatening or abusive manner by shouting and swearing and refusing to leave the house in the Summerfield area of Earlston when requested to do so.

Depute fiscal Joanna Waller said Goodall arrived at her partner's home to spend a few days and appeared in good spirits and talking about moving in together.

But her partner went to a get a carry out and she fell asleep on the sofa appearing to be under the influence of something.

He carried her through to the bedroom but she fell onto the floor before hurling the phone at him.

The partner went away to his work in the morning and had told her to leave but she did not.

He came back to the house at 8.30am and again asked her to leave but she just swore at him.

The man packed up her belongings in an attempt to get her to leave.

Ms Waller said the police were contacted by the partner who was still experiencing abuse from Goodall.

Eventually she left at 10am and was traced by police who cautioned and charged her.

Goodall confirmed to the court the relationship was now over and said: "I had far too much to drink. I am sorry for what I did."

She was fined a total of £300 with a £20 Victim Surcharge.

A one year Non Harassment Order was imposed preventing her from having any contact with her former partner.
