A 40-YEAR-OLD man breached his Sexual Offences Prevention Order by being intoxicated through alcohol.

The order relating to Mark King prevents him from being under the inluence of alcohol in a public place or at a private address that has not been approved.

King appeared from custody at Selkirk Sheriff Court and pleaded guilty to the offence which happened at a house in Jura Drive, Tweedbank, last month.

Depute fiscal Tessa Bradley told a previous hearing King’s partner had telephoned the police at around 2.25pm to say he was at the house and under the influence of alcohol.

She continued: “Officers made their way to the house and found the accused asleep upstairs. It was immediately evident to them that he was under the influence. He was arrested for breaching the terms of his SOPO.” She explained he was given a breath test which gave a reading of 106 microgrammes - more than three times the legal drink drive limit of 35 microgrammes.

King’s lawyer said he had gone to the friend’s house and was offered alcohol by his friend and “temptation got the better of him”. He added: “He was trying to sleep off the effects of the alcohol he had consumed knowing his partner would disapprove.” The lawyer said that his partner did not realise the serious position King would be in by contacting the police and breaching the alcohol order.

Sheriff Kevin Drummond imposed a 40 day jail sentence which was back-dated to December 15 when King of Magdala Terrace, Galashiels, was rermanded in custody.
